General terms and conditions of contract and travel

1. subject matter and applicability of the contract and travel conditions
1.1 These contractual and travel conditions regulate the legal relationship between our customers and us for package tours and other travel services from the tour offer, which is published in the respective brochure, the Internet or elsewhere.
1.2 The AVRB distinguish between package tours and other travel services. A package tour exists if the pre-arranged combination of at least two of the following services is offered at a total price and lasts longer than 24 hours or includes an overnight stay: Transportation, accommodation or other tourist services that are not ancillary to transportation or accommodation and constitute a significant part of the total service.
1.3 If travel arrangements or individual services of other tour operators or service providers are arranged for you by the booking office or via one of our websites, we are not a contractual partner but merely an intermediary, and their own contractual and travel conditions apply. For additionally arranged transportation services (airline tickets, ship, train, bus tickets, rental of vehicles, etc.) as well as for all other services provided by third parties, the contract and travel conditions as well as the limitations of liability of the respective transportation company, service provider or rental company shall apply. In all these cases, our service as an agent is limited to providing you with the services offered by third parties (tour operators, transport companies and other service providers) in accordance with your order for a fee (flat order fee and agency commission). Our own service in these cases is limited to the dutiful mediation of the corresponding contract and, with appropriate authorization on your part, to its conclusion on your behalf. In these cases, we assume no liability whatsoever for the services provided by the third parties.
2. conclusion of contract
2.1 The contract between you and us comes into effect with the written confirmation of your personal, telephone, written or electronic (online) registration (booking). If the person making the booking registers additional travel participants, he or she shall be liable for their contractual obligations (in particular payment of the travel price) as for his or her own obligations. These AVRB apply to all travel participants.
2.2 If your booking is initially made provisionally (option), the contract between you and us - subject to your earlier express and definitive consent - shall be concluded at the latest if you do not cancel it in person, by telephone or in writing at your booking office within three working days of the date of the provisional booking.
2.3 By booking, you confirm that you have understood and unconditionally accepted the AVRB (General Terms and Conditions of Contract and Travel).
2.4 The booking person declares with the conclusion of the booking that he/she is of age (18 years) and therefore fully capable of acting. If the booking is made by a minor, we can in no case be held liable. Users and/or parents or guardians are solely responsible for accessing the website. If, in the case of an improperly made booking, minors nevertheless wish to receive the booked services, these may be refused by the service partners (airline, hotel, etc.). The consequences and costs of an improper booking must be borne jointly and severally by the underage person himself, by his parents or legal guardians.
2.5 After booking, you will receive the travel confirmation via your booking office, which contains all essential contractual information about the services you have booked. If the travel confirmation differs from the content of your booking, this must be reported immediately. In the case of feedback more than 24 hours, we can unfortunately not make any corrections. The travel contract is concluded on the basis of this new offer, if you accept the offer within this period by explicit or conclusive declaration (deposit or full payment of the travel price). If you would still like to make any changes after the expiration of the granted validity period of the offer, these are subject to costs according to the provisions in section 7.
2.6 For the safety and in the interest of travelers, we expressly reserve the right to refuse to conclude the contract after our assessment of the suitability for travel. Any accrued or additional costs will be charged.
3. services
3.1 We undertake to carefully fulfill the promised services of the tour according to the service description in the invitation to tender valid at the time of your booking and the confirmation. In case of contradictions, the confirmation is decisive.
3.2 Our publication in the respective brochure, advertisement or on the Internet shall be exclusively authoritative for the service to be provided. The photos used in our publications are for illustrative purposes only and do not represent any promises. Special services must therefore be described in the respective brochure and listed in the confirmation. Other brochures (hotel brochures and other information material not produced by us), Internet pages of service providers or own inquiries to the service partner are not subject matter of the travel contract; we are not liable for the information contained therein.
3.3 The services begin at the published or confirmed departure, departure or boarding point. You are responsible for your own timely arrival.
3.4 Special requests are only binding and part of the contract if they are expressly accepted by us in the confirmation and listed individually.
3.5 As a travel participant, you undertake to pay the agreed (package) price for the trip as well as any special services not included in the (package) price (e.g. insurance premiums, security and airport taxes, visa fees, excursions, fees for invoiced extra services), to comply with the payment modalities, to obtain the necessary personal travel documents and to comply with the passport, visa, customs, foreign exchange and health regulations of the country of travel.
3.6 In the case of voyages by ship, the services of the ship's doctor do not form part of the contract. Only the prophylaxis against or treatment of seasickness and the treatment of accidents caused by the responsible shipping company or its employees that occur on board or during shore excursions organized by the shipping company are free of charge. In all other cases, the doctor will charge a fee for his services. The medicines dispensed will also be charged to the passenger.
4. prices
4.1 Unless otherwise stated, prices are per person in Swiss francs. It may occur that individual trips are published in a foreign currency (e.g. in euros). For the calculation of the definitive travel price, the exchange rate at the time of booking applies. If you book your trip directly online, the price of the trip will automatically be shown in Swiss francs. Please note that the exchange rate can change between the time of the exchange rate query and the booking. If discounts etc. are offered for individual groups of people (e.g. children, senior citizens), the number of full-paying travel participants is decisive for the price calculation. For example, if the stay of a child in the same double room as the parents is free of charge, the price will be calculated on the basis of two full-paying persons. All prices include the legal value added tax. The prices can be found in our invitation to tender for the respective offer or in the corresponding price list. The validity of the advertised prices for the extensions and the maximum length of stay may be limited.
4.2 The published prices of an offer (e.g. in the catalog, brochure, Internet) become invalid with the new issue of the same offer (e.g. in the catalog, brochure, Internet) for newly booking customers. The prices valid at the time of booking shall apply. For all-inclusive arrangements - exceptions are listed accordingly - the date of departure is decisive for the price calculation, for the other offers (exceptions according to the advertisement) the date of service receipt. The advertised package prices of the respective last departure according to the winter or summer brochure are valid for a maximum stay of one week. Thereafter, the prices and conditions of the following season apply.
4.3 For individual offers or types of travel (e.g. individual travel), guideline prices are often published instead of fixed prices. Due to fluctuating exchange rates, prices are subject to change. You will find out the current price at the time of booking.
4.4 The advertised prices apply exclusively to customers with permanent residence in Switzerland. For all other customers, it is possible that in certain cases the hoteliers may demand an additional payment to be made on site at the advertised price. It is therefore imperative that the correct names and home addresses of the actual travelers are provided at the time of booking. The booking office and the travelers are responsible for compliance with the provision.
4.5 It may happen that individual services (e.g. flights, hotels) are no longer available or fully booked on the published date at the published prices. In such situations, we will recommend an identical or similar service that is subject to an additional charge, either from our side or upon request.
4.6 In addition to the published travel price, your booking agent may charge a service or consulting fee or a flat-rate order fee as well as a share of the costs for reservations and processing.
4.7 In the case of Internet bookings of flights, we are only an intermediary within the meaning of section 1.3. The contract with the airline is concluded when the tickets are issued by us.
4.8 Booking and service fees
4.8.1 For bookings of country-only arrangements (e.g. booking of accommodation or round trip without advertised flight service) which are published as package tours, for bookings at short notice (less than 7 days before departure) which require queries, for tours with an individual stay (e.g. 1 week with hotel, 2nd and 3rd week without hotel) as well as for tours which you would like to customize in modification of the advertisement - if possible - the following rules apply depending on the offer: Either special prices (e.g. per person, per day/night/week) are published for such offers or we charge a booking fee. You will find out the details when you make your offer.
4.8.2 Children discounts
The age at the start of the trip is decisive. Regardless of this, each accompanying child and its age must be specified when booking. Please refer to the respective service description for the scope of child discounts. Within the framework of package arrangements with scheduled air transportation and in the case of flight-only offers (charter or scheduled flights), the tour operator will charge a flat rate for children under 2 years of age, without entitlement to a seat of their own. In case of incorrect age information, the tour operator is entitled to charge any difference between the paid and the correct travel price plus a handling fee of CHF 100 retroactively. If a child under 2 years of age reaches the age of 2 after departure and before return, a seat must be booked and paid for the return flight.
5. terms of payment
Unless otherwise agreed, a deposit and the premium for the booked insurance services is due upon conclusion of the contract and must be paid to the booking office immediately. It amounts to 30 % of the total tour price. The balance must be paid no later than 4 weeks before departure. For bookings made within 4 weeks of departure, the total amount is due upon conclusion of the contract. Non-payment in time entitles us to cancel the travel contract without further notice and to refuse the travel services not yet received. Any costs arising from the cancellation will be borne by you. For individually arranged trips or for group trips, other conditions may apply according to the offer or booking confirmation. The entire travel price for online bookings and for special offers is due in full 10 days after the reservation or receipt of the booking confirmation, unless otherwise agreed. In the event of any repayments of partial or total payments of any kind to you (e.g. due to changes in services, cancellation), we do not owe you any interest.
6. price changes
It is possible that the prices published in the brochures, catalogs, etc. and on the Internet must be changed, especially in the following cases:
- In case of subsequent price increases or tariff changes of independent transport companies (e.g. fuel surcharges) since the date of printing of the offer or the conclusion of the contract.
- In the event of an increase in or the introduction of new government levies and charges (e.g. security and airport taxes).
- In the event of an increase in taxes or public law fees (e.g. security and airport taxes or port fees).
- In the event of changes in exchange rates since the date of conclusion of the contract, the tour price may be increased to the extent that the tour has become more expensive as a result for the booked tour operator brand.
In these cases we reserve the right to further charge price increases, but no later than 32 days before the agreed travel date. We will notify you of the price changes immediately.
7. you can not travel or change the order
7.1 Cancellation
If you are unable to commence the trip on the agreed travel date, you must inform your booking office, i.e. Handeys GmbH, of this immediately in person, by registered letter or e-mail and by enclosing or separately returning any travel documents already issued. The cancellation notice is to be considered as received only after reconfirmation by Handeys GmbH. The organizer can, as far as the cancellation or the non-commencement of the journey is not his responsibility and is not a case of force majeure, demand an appropriate compensation ("cancellation costs or cancellation fees") depending on the respective travel price. The cancellation costs - calculated from the booking date - are listed below under section 7.1.1 et seq. taking into account the proximity of the time of withdrawal to the contractually agreed start of the trip mostly per person or charged service unit in a percentage ratio to the travel price or as a lump sum. In addition, we charge a deductible (handling fee) of CHF 100 per person, up to a maximum of CHF 200 per order*), as well as the premium for the travel insurance you have taken out.*) If an order consists of several dossiers or transactions in which the customer data are listed, the above-mentioned deductible of CHF 200 per dossier or transaction will be charged.
In this context, it is imperative that you observe Section 9 "Travel insurance and protection" and the insurance offers in the invitation to tender (e.g. catalog, price list, Internet). When taking out individual insurance offers that cover the cancellation costs, the processing fees (deductible) are also covered by the travel insurance in addition to the cancellation costs. In case of non-purchase of the service or non-commencement of the trip (no-show), late arrival at the place of departure or departure or missing the departure or departure due to insufficient travel documents, etc., we will charge 100 % of the arrangement or service price. Your booking office may additionally charge a share of the costs for consultation and processing (see section 4.6). The date of receipt of your cancellation by us or your booking office is decisive for the calculation of the cancellation costs.
7.1.1 Standard rule
Package tours, last-minute offers, individual components of package tours, such as flight-only or country-only arrangements (rental cars, round trips, short tours, etc.), flight-only charters, hotel-only charters, vacation homes/apartments, apartments or caravan parks with own, bus or train arrival; motorcycle tours, golf packages:
- Directly after booking until 31st day before departure 50 %
- 30 - 15 days before departure 80 %
- On the day of departure up to 14th day before departure and in case of no-show100 %
7.1.2 For special scheduled fares (e.g. also from frequent flyer, reward, bonus or other customer loyalty programs), for all scheduled flights booked on the Internet and for bookings of flights with low-cost carriers, the cancellation conditions specified by the airlines apply depending on the type of fare. The conditions will be communicated to you before or at the time of booking and/or with the written confirmation.
7.2 Changes and rebookings
For changes of travel date, destination, place, start of travel or accommodation after conclusion of the contract, we will charge you a fee of CHF 100 per person, but not more than CHF 200 per order. For the same changes within the cancellation deadlines according to section 7.1, the cancellation costs mentioned there are additionally due. Changes or rebookings - often in connection with partial cancellations - may result in additional costs (e.g. from double to single room, failure to reach the number of full-paying guests per room), which shall be borne by you. Depending on the tariff, the airlines have strict conditions regarding changes, rebooking, etc. before and after the tickets are issued. Any expenses of this kind demanded by the airlines or other service providers will be charged to you in addition to the handling fee. In the case of flight rebookings requested by travelers in the destination area, the organizer reserves the right to charge an appropriate processing fee in addition to any additional costs incurred.
8. you start the trip but you cannot finish it or you cannot finish it according to the contract - early termination
If you break off your trip prematurely for any reason, you are not entitled to a refund of the tour price or the unclaimed services. However, we will refund services not claimed by you if and to the extent that they are refunded to us by the service providers. We are entitled to deduct a handling fee (min. CHF 100 per person) calculated according to the expenses incurred by us in the process. Refusal of landing permission and entry, costs of onward travel If on a ship or air journey the landing or - also in the case of an air journey - your entry and/or the import of your luggage into the intended port or country is refused because you have violated the relevant regulations, assistance can be provided as soon as it is possible for us. You must pay us the appropriate fee and reimburse us for all other expenses incurred in connection with the onward journey. These travel conditions and, in the case of special trips, any deviating published or supplementary conditions (see section 1.1) apply to such a continuation of the trip.
9. we are unable to carry out the trip as agreed or have to terminate it prematurely
9.1 Program changes, non-implementation, trip cancellation
9.1.1 Program changes
According to our assessment, it may prove necessary to change the travel program or individual agreed services such as accommodation, means of transport, airlines, the departure or arrival airport, the port of departure or arrival as well as flight or departure times after conclusion of the contract if force majeure or other unforeseeable or unavoidable circumstances (e.g. due to special circumstances in air or shipping) make it necessary. In the event of significant changes, we will endeavor to offer you a substitute service that is at least equivalent from our objective point of view and that does not significantly affect the overall nature of the trip. If a substitute program is not possible, there will be no refund of payments already made, but only a credit to your customer account, which we will create internally for you. As the organizer, we are obligated to inform you immediately of any significant changes or deviations in services. There is no right to the implementation of a substitute program. Claims for damages due to non-fulfillment of the contract are excluded. The flight times indicated on the flight ticket are considered as scheduled. Due to the temporary congestion of international airspace, flight delays or postponements as well as changes in routing in individual cases cannot be excluded. Possible warranty claims remain unaffected, especially if the changed services are defective. If necessary, we will offer you a free rebooking at catalog prices or a free cancellation. If the seat reservation for air travel is not kept, we will refund the reservation fee - if necessary on a pro rata basis.
9.1.2 Failure to carry out a trip
If there are reasons that make the implementation of a trip impossible, such as force majeure, warlike events, riots, strikes, official measures, bankruptcy of the service provider, or denial of landing rights, permits, etc., or circumstances that in our view could lead to danger to life and health, we as organizer have the right to cancel the trip even at short notice. In this case, we will make every effort to offer you a substitute solution. If a substitute program is not possible, there will be no refund of payments already made, but only a credit to your customer account, which we will create internally for you. There is no entitlement to the implementation of a substitute program. Should the service provider file for bankruptcy (this can be the organizer, the airline, the hotel, the transfer company, the car rental company) all claims for services from this company expire. No refund or credit can be given to the customer. Claims for damages due to non-fulfillment of the contract are excluded.
9.1.3 Cancellation of a trip - In general
If the trip or stay has to be interrupted for the reasons mentioned in section 9.1.2, we will make every effort to return the travel participants to another vacation destination or to Switzerland as quickly as possible. We are entitled to deduct our proven expenses before refunding your payment. Claims for damages due to non-fulfillment of the contract are excluded.
9.1.4 Cancellation of a voyage - Special shipping circumstances
If a ship has to be quarantined for reasons for which we are not responsible, you have to bear the costs for your upkeep yourself. If you are on board and are catered for there, you must reimburse the additional costs incurred.
9.1.5 Termination
We can terminate the contract without notice if the performance of the trip is disturbed by you despite an appropriate warning from our side. The same applies if you behave contrary to the contract to such an extent that the immediate cancellation of the contract is justified. However, we retain the right to the travel price. Any additional costs for return transportation shall be borne by you as the disruptive party. However, the value of saved expenses as well as those benefits that are obtained from another use of unused services, including any reimbursements by service providers, will be credited to you.
9.2 Minimum participation
For certain trips there is a minimum number of participants, which can vary depending on the trip and is published with the offer. If too few participants take part in a trip, we can cancel the trip up to 22 days before the agreed travel date. We will inform you as soon as possible if it becomes apparent at an earlier stage that the minimum number of participants cannot be reached. In this case, we will endeavor to offer you a substitute service of at least equal value according to our objective criteria, which does not significantly affect the overall character of the trip. If the substitute program is more favorable according to our catalog price, we will reimburse you for the difference in price. Price changes at your expense are permissible within the scope of section 6. If the substitute program is more expensive, we are authorized to charge a small group surcharge. If a substitute program is not possible, there will be no refund of payments already made, but only a credit to your customer account, which we create internally for you. There is no entitlement to the implementation of a substitute program. Claims for damages due to non-fulfillment of the contract are excluded.
10. liability provisions
10.1 Disclaimer
10.1.1 We shall not be liable for services provided by third parties (tour operators; transport companies and other service providers) which we have only arranged in accordance with your order and where we are not a contracting party (cf. Section 1.3 AVRB).
Our liability in these cases is limited to the careful provision of the agency service. Outside of the package arrangement, local events, excursions and other services can be booked at the destination, which are associated with special risks or require special physical conditions due to local circumstances. You book such events at your own risk. We are not your contracting party. We decline any liability for these and for services requested by you from the tour guide outside of the package arrangement, unless we or our local representative are expressly responsible as organizer or service provider for such offers.
10.1.2 We shall not be liable if the non-performance or improper performance of the contract is due to the following causes:
- To failures on your part before or during the trip.
- To unforeseeable or unpreventable failures of third parties who are not involved in the provision of the contractually agreed services.
- To force majeure or to an event which we could not foresee or avert despite all due care, namely strikes, flight delays, political unrest, natural disasters and official measures.
Furthermore, we shall not be liable for program changes pursuant to Section 10, but shall endeavor to offer you a substitute service that is at least equivalent according to our objective criteria.
10.1.3 Liability for voyages by ship
Insofar as we have the position of a contractual or performing carrier in the case of voyages by ship, our liability shall be governed by the respective applicable special international agreements or statutory provisions based on such agreements.
10.2 Accidents and illnesses (personal injury)
For the direct damage in case of death, bodily injury or illness during the trip, which was caused by companies contracted by us, the corresponding company is liable, which is responsible for these circumstances. You must assign your claims for damages against these companies directly. In cases of liability arising in connection with air transport or the use of other transport companies (railroad, shipping, bus companies, etc.), the claims for compensation are limited to the amount resulting from the applicable international agreements or national laws. Any further liability on our part is excluded in these cases. See also clause 11.
10.3 Information on air travel
Carriage by international air is subject to the provisions of the Montreal Convention or Warsaw Convention with respect to liability for death or personal injury of passengers, delay of passengers and/or baggage, and destruction of, loss of, or damage to baggage. Which convention applies under which conditions depends on which states have signed and ratified the conventions. Contracting states that have signed and ratified the Montreal Convention and the Warsaw Convention can be found on the Internet at www.icao.int. Claims for compensation for denied boarding, flight cancellations and delays are governed, among other things, by European Council Regulation (EC) No. 261/2004 of February 11, 2004, establishing common rules on compensation and assistance to air passengers. In addition to its own law, Switzerland has adopted the air passenger rights of the European Union (EU). Please refer, among other things, to section 12.3 and www.bazl.admin.ch, under the heading "Safety".
10.4 Purchases
We disclaim any liability for contracts you enter into with merchants or vendors for goods or services while traveling.
10.5 Other damage (property damage and financial loss)
In the event of other damage (property damage and financial loss), the party responsible for it, We are not liable for the conduct of third-party companies engaged by us. You must assign your claims for damages against these companies directly to them. In the event of damage and loss occurring in connection with air transport or the use of other transport companies (railroad, shipping, bus companies, etc.), claims for compensation are limited to the amount resulting from the applicable international agreements or national laws. Any further liability on our part is excluded in these cases.
10.6 Insurance cover
Our liability is limited in accordance with these liability regulations, as is the liability of the airlines or other transport companies, which are governed by international agreements or national laws. We would like to draw your attention to the fact that the transport companies in various countries have only insufficient insurance coverage for accidents, loss or damage of luggage, etc. due to the lack of a legal basis. We recommend that you check your insurance coverage and, if necessary, take out appropriate travel insurance for the duration of the trip, such as baggage, travel incident, travel accident and/or travel health insurance. If you have private insurance coverage for cancellation costs, you may request a waiver from your booking agent.
11. complaints/replacement claims
11.1 In the event of disruptions to performance, you are obligated to cooperate within the scope of the statutory provisions to avoid or minimize any damage (obligation to cooperate).
11.2 If an agreed service is defective or not provided at all, you are entitled and obliged to demand immediate and free remedy from our travel management or local representative (e.g. transfer company, hotelier, ship management). We will endeavor to find suitable solutions in your interest. If remedy or an appropriate solution is not possible within 48 hours, you are entitled to provide remedy yourself. If an equivalent substitute service cannot be provided, you are entitled to a price reduction in the amount of the objective reduction in value of the service provided in relation to the agreed service or, against appropriate proof, to reimbursement of the costs for your own remedy within the scope of the originally agreed service. Further claims for compensation are excluded. If a service deficiency occurs or you can no longer be expected to continue the trip or stay due to serious deficiencies, you must have your complaint confirmed in writing by our tour guide or local representative. They are not entitled to validly recognize any claims for damages and similar claims (e.g. satisfaction). In order to assert your claims, your complaint and the written confirmation of the notice of defects from our travel management or local representative, as well as any evidence, must be submitted to us immediately, but no later than 30 days after your return (for package tours) or after receipt of the service (for individual tours and services). Please make sure that you write your complaint yourself so as not to jeopardize any claims you may have. If you do not immediately report your complaints on site and do not assert your claims within 30 days after your return or after receiving the service (in the case of individual trips and services), you forfeit your rights to remedy, self-redress, price reduction, termination of the contract, damages and satisfaction.
11.3 Damage, loss or delayed delivery of baggage during air travel must be reported to the responsible airline or representative by means of a notice of claim (P.I.R) after arrival on the spot, but no later than within seven days after discovery of the damage. Airlines will refuse refunds if the damage report has not been completed or has been made too late. Otherwise, the loss, damage or misrouting of luggage must be reported to the tour guide or the local representative of the organizer.
11.4 In case of complaints, guests of vacation apartments / houses / apartments must immediately request remedy from the contact person indicated in the travel documents. If the defect is not remedied as requested, you are obliged to contact the nearest tour guide or the local representative of the organizer. If you culpably fail to report a defect, you are not entitled to any claims. The explanations according to section 12.2 apply in addition.
12. travel guarantee
As a tour operator, we are a participant in the Guarantee Fund of the Swiss Travel Industry and guarantee to secure the amounts you have paid in connection with the booking of a package tour.
13. passport, visa, customs, health and foreign exchange regulations.
13.1 You are responsible for compliance with passport, visa, customs, health and foreign exchange regulations in any transit country and in the country of destination. For nationals of other countries, the consulate of any transit country and the country of destination will provide information. The travel description in the catalogs, advertisements, etc. and with the travel documents you will receive essential information about the formalities necessary for your trip. Please take note of this information and seek further guidance from your booking office. The contacts of the foreign representations in Switzerland can be found at www.eda.admin.ch; category "Representations". (subject to change without notice).
13.2 We and the booking office are not liable for the timely issuance of necessary visas by the respective diplomatic representation and the timely arrival at your place if you have commissioned us or the booking office with the procurement, unless we or the booking office are responsible for the delay. To obtain visas etc. from the relevant offices, you must expect a period of up to 8 weeks.
13.3 You are responsible for compliance with all regulations important for the implementation of the trip. All disadvantages, in particular the payment of cancellation costs, arising from non-compliance with these regulations shall be borne by you, except in the case of demonstrably culpable misinformation or non-information by us or the booking office.
13.4 Please refer to the invitation to tender or ask your booking office whether a passport is required for your trip or whether the identity card (ID card) is sufficient. Make sure that your passport or identity card has sufficient validity for the trip. Outside of Europe, the passport must be valid for at least 6 months beyond the return date. Children must have their own identity card applied for by their legal representatives from birth. For information on ID formalities, see www.bap.admin.ch or www.schweizerpass.ch.

16.6 Various countries require certain vaccination certificates. Information can be found in the travel brochure or obtained from your booking office. For medical recommendations and advice on preventive health care and health risk assessment, we refer you to your family doctor, doctors experienced in travel medicine or tropical medicine, the travel medicine information services or the Federal Office of Public Health (FOPH).
13.7 We, the booking office do not assume any liability if you cannot be transported or entry or exit is refused due to the violation of passport, visa, customs, health and foreign exchange regulations. In these cases you are not entitled to a refund of booked services. Any additional costs incurred due to the disregard of travel regulations of any kind (e.g. accommodation, return, rebooking, transfer or other costs) are to be borne by you in full.
13.8 For safety reasons and due to the limited medical care on board a ship, we advise expectant mothers who are in the 24th week of pregnancy or beyond at the start of the voyage and infants up to the age of six months not to take part in a voyage by ship. On the transatlantic routes and the route around Western Europe, infants under 12 months of age are strongly discouraged due to the many consecutive sea days.
14. criminal behavior
If there is an urgent suspicion that you have committed a criminal act punishable by imprisonment under Swiss criminal law at the vacation resort or during the trip, we are entitled to terminate the travel contract with you without notice. The legal consequences are the same as if you terminate the trip prematurely (section 8). Claims for damages on your part due to non-fulfillment of the contract are excluded. We reserve the right to report our suspicions to the Swiss law enforcement authorities.
15. special provisions for voyages by ship
15.1 General average
Your obligation to contribute to a general average and any claim for compensation in the event of damage forming part of a general average shall be governed by the law applicable to the ship.
15.2 Assistance - salvage - cargo transportation
The master is authorized to render assistance to other vessels with the deployed vessel, to tow and salvage vessels and to carry cargo of any kind. All such activities, whether announced in advance or not, are considered part of the voyage.
16.pandemic/epidemic
During a pandemic or epidemic, the measures prescribed by the government apply. Flight bans and exit bans must be observed.
16.1 Cancellation of bookings
16.1.1 Package tours
The package tours, which cannot be started due to the governmental measure decided by the pandemic or epidemic, can be canceled or rebooked. For the rebooking, the rebooking regulations of the tour operator apply. In case of cancellation, the terms and conditions of the tour operator apply. According to these regulations, it is determined whether the trip can be canceled free of charge or for a fee. In the event that the cancellation gives rise to a right to a refund, the refund shall be made as a credit to the customer's account. 16.1.2 Flight only
The flight booking, which cannot be taken due to the governmental measure decided by the pandemic or epidemic, can be canceled or rebooked. The rebooking is subject to the airline's rebooking policy. In case of rebooking with extra charge, it must be paid by the buyer. In case of cancellation, the terms and conditions of the airline apply. According to these regulations, it is determined whether the flight can be canceled free of charge or for a fee. In the event that the cancellation results in a claim for a refund, the refund will be made as a credit to the customer's account. The hotel reservations that cannot be made due to the governmental measures decided by the pandemic or epidemic can be canceled or rebooked. For the rebooking, the rebooking regulations of the tour operator apply. In case of cancellation, the terms and conditions of the tour operator apply. According to these regulations, it is determined whether the trip can be canceled free of charge or for a fee. 16.2 Bookings with installment payment option
Bookings made with the possibility of payment in installments must be paid monthly despite the fact that the trip cannot be taken. The fact that the trip cannot be taken is not a pretext for suspending the payment of the installments. Handeys cannot be held responsible for the fact that due to the fact that the trip cannot be taken, the installments still have to be paid. In case of non-payment of the installments, the partners will, as contractually stipulated, remind the customer and, if necessary, initiate legal collection. For all costs incurred by the non-payment, the installment payment, the customer is responsible.
16.3 Bankruptcy of tour operator or airline company
If in the period of the pandemic or epidemic, a refund is granted by a tour operator or airline, but without refunding this claim, the tour operator or airline declares bankruptcy, all claims are forfeited. In the event of bankruptcy, no funds can be deposited for the customer, and the claim is forfeited. The liability of Handeys Ltd. for this damage is excluded.
